Welcome to Lookinfy, the digital platform operated by Lookinfy S.L., with registered office at Pl. Europa 126, 8.D, Districte Econòmic, 08902 – L'Hospitalet de Llobregat (Barcelona), Spain, and contact email support@lookinfy.atlassian.net (hereinafter, "Lookinfy", "we" or "our").
Accessing, browsing and using the website www.lookinfy.com (hereinafter, the "Website" or "Platform") implies the express and unreserved acceptance of all the terms in this document. If you do not agree with these conditions, you must not use our services.
1. Purpose of the service
Lookinfy acts as an intermediation platform that brings together:
- Hosts, owners or managers of spaces (retail spaces, shop windows, warehouses and pop-up venues) who wish to rent them by the hour or day;
- Users, individuals or entities who wish to book these spaces for lawful temporary activities.
Lookinfy is not a direct party to the rental contract between the parties. Our role is to:
- Provide the digital infrastructure for contact and booking;
- Verify listings before publication;
- Process payments on behalf of the Host through Stripe Connect;
- Withhold an intermediation commission;
- Offer additional services such as promotion, assistance and support.
2. User registration and accounts
To use the services, the User must register through authentication with a Google account, providing truthful and updated data and expressly accepting these terms and the privacy policy. Each User is responsible for the use of their account and for keeping their session confidential.
We reserve the right to suspend or cancel fraudulent, inactive accounts or those that violate these terms.
3. Listing publication and verification
All listings must pass an editorial and documentary verification process by Lookinfy before being published, including, among others:
- Verification of the Host's identity;
- Validation of ownership or availability of the space;
- Review of content, images and conditions of use.
Additionally, Hosts must complete the identity and tax data verification process of Stripe Connect in order to receive payments. We reserve the right to reject listings that do not meet legal requirements or quality standards.
4. Bookings, commissions and payments
Bookings are made through the Platform. The User pays Lookinfy via Stripe, which withholds an 18% commission on the base amount, plus the corresponding VAT (21%), and transfers the remaining amount to the Host after the service is provided via Stripe Connect.
- Payment authorization happens when the booking is confirmed; effective capture happens when the Host approves the booking or automatically for instant bookings.
- Hosts can check their balance, bookings and operations from their management panel.
- Payment includes the booking cost plus, if applicable, additional contracted services.
5. Cancellations and refund policy
Each Host may set their own cancellation conditions, visible before confirming the booking. Additionally:
- Bookings pending approval expire automatically after 7 days, releasing the payment authorization.
- Cancellations by the Host fully release the User's authorization.
- Lookinfy will act as an intermediary to process, where applicable, partial or total refunds within the established deadlines.
6. Obligations of users and hosts
Users and Hosts undertake to:
- Use the Platform in accordance with current legislation;
- Refrain from using spaces for unlawful or dangerous purposes;
- Not provide false or inaccurate information;
- Not contact off-Platform to avoid paying commissions (prohibited practice).
Non-compliance may result in account cancellation and, if applicable, legal action.
7. Limitation of liability
Lookinfy is not responsible for:
- Material, personal or economic damage during the use of the space;
- Delays, cancellations or breaches by the Host or User;
- The truthfulness of content published by Hosts;
- Losses due to use of the Website or technical failures of third parties (Stripe, Google).
However, Lookinfy provides a support channel to mediate in disputes and incidents.
8. Additional services
Lookinfy may offer complementary services such as:
- Featured promotion of listings;
- Technical and editorial assistance;
- Invoicing and issuance of supporting documents for Hosts and Users.
The particular conditions of these services will be detailed at contracting.
9. Intellectual property
The content, design, brand, logos and structure of the Website are the exclusive property of Lookinfy S.L. or their respective owners and are protected by current legislation. Their full or partial reproduction without express authorization is prohibited.
10. Data protection
Lookinfy complies with the General Data Protection Regulation (EU 2016/679) and Organic Law 3/2018 (LOPDGDD). Personal data is processed according to our Privacy policy, accessible at all times.
11. Modifications
Lookinfy may modify these Terms at any time. The modifications will take effect from their publication on the Website. Periodic review of the current Terms is recommended.
12. Applicable law and jurisdiction
These Terms are governed by Spanish law. In case of conflict:
- If the User acts as a consumer, jurisdiction shall be that of their domicile;
- Otherwise, the parties submit to the courts of Barcelona, expressly waiving any other jurisdiction.
